Like suppose you wear a power armor which makes you super strong and near invincible and wield a stun gun, and you watch one person slowly beat another to death with his bare hands.
Do you think the defense of "I wanted to give the murderer free will" will fly in court?power armor?? super strength? what are you planning to do sir? LOL
Super hero or not if you watch someone being harmed and you do nothing about it hell yes you are an accomplice and No i don't think that defense is going to keep you from a jail cell... and think about how you would feel...maybe nothing at first but as the years passed it would eat away at you insidehmm... it all depends on the crime... being there does not make you an accomplice helping the "crime maker" makes you an accomplice ex. If im on the street walking and i see a fight and i dont help but i keep watching and the man ends up dying im not an accomplice it was a bad point in judgement not to help the man but im not an accomplice I didnt hit the man or do anything to help the assaulter do more damage or get away etc. If there was a drive by and im in the car im an accomplice but that's a completely different storyHe's certainly am accomplice...Especially if he was a powerful being.Not an accomplice but a complicitor, except for the fact that complicitor is not a word, but you get the idea.As far as the law in the US is concerned, stopping the murderer would be assault, possibly with intent to kill, and you'd go to prison. Laws vary from state to state even between jurisdictions. If you have a gun and go to the aid of a 3rd party, you can be charged along with the attacker or perhaps, instead of the attacker! It also depends on how the cops write up their report of the matter.
So while doing nothing may make you a witness, any action by yourself could make you a victim.to answer your question: no. an accomplice must actively assist in the execution of the crime. btw, if you believe in the christian god then this pretty much describes him.It works for 'God', why not for a human?duh,
three totally different scenarios may answer your question.
1 were you around when the beating was first planed?
2 did you try to dial 911 for police intervention?
3 did you just watch it as it happened and left after without even try to call 911 for an ambulance to pick up the person?
1st-no
2nd- yes, by just enjoying the full beating and slaying of one person by another, you have not tried to stop it at that point you can actually be tried as a conspirator to murder.
3rd. yes, by walking way without dialing 911 for help you have implicated your self in an intentional act of murder also.
you might at that point the courts might give you manslaughter and leaving the crime scene victim to die.
no this would not be a light sentence called for,
try it and see how many years it will take before your next parole hearing is set.
